- After watching an episode of Oprah, regarding repressed memory, the complainant decided that she had been molested and sexually assaulted by a family friend, several years earlier. Rigorous cross-examination revealed that the complainant had numerous inconsistencies in her story and that her story constantly expanded over time. She developed more details about the sexual assault and insisted that it was not that her memory was repressed, but rather she had always remembered the story but did not know the words that would allow her to express herself and make a complaint. After going over her various statements it was established that she knew the meaning of sexual assault, molestation and other key concepts many years prior to her making the complaint. Mr. Boggs successfully argued, that the complainant may well and sincerely believe that she had been sexually assaulted, but that her story was too bizarre and too inconsistent, for the court to believe it, beyond a reasonable doubt. Our client was acquitted.
